Venezuela Designated For Temporary Protected Status (TPS)

On March 8, 2021, it was announced that the Department of Homeland Security (DHS) has designated the country of Venezuela for Temporary Protected Status (TPS).

A designation of this type is usually granted to countries facing a severe humanitarian emergency such as an economic crisis, political tension, shortage in food and collapsed health system, lack of basic services, high crime rate and violence, which Venezuela has been experiencing for years.

TPS will enable Venezuelan nationals who can demonstrate they have been residing in the United States as of March 8, 2021 to file for initial TPS application that would prevent them from Removal as well as allow them to file for Employment Authorization Documents (EAD).

The designation for Venezuela is effective as of March 9, 2021 for 18 months through September 9, 2022.

There is a 180-day registration period for eligible individuals to submit their TPS applications from March 9, 2021 to September 5, 2021.

Deferred enforced Departure (DED) for Venezuelan nationals is also effective through July 20, 2022. DED is an administrative stay of removal order by the former President. It is basically a directive not to remove individuals. Unlike TPS it does not require an application form to obtain coverage. However, qualifying Venezuelan nationals may apply for a DED EAD.
