Canada Grants Temporary Residence to Victims of Domestic Violence

In a move that could be ground breaking and hailed as a significant step towards international compassion towards victim, Canada has decided to issue temporary resident permits for those victims of family violence who are currently living out-of-status in the country. The aim of the program is to provide an opportunity for Canada immigration for vulnerable foreign nationals.

Canada Immigration Initiative to Protect Victims of Domestic Violence

People who have newly arrived in Canada, especially those who arrive on a dependent visa, can face oppression, exploitation and violence in the hands of the primary status holder. This is an evil problem that faces thousands of dependent spouses across the world. Canada is now the first country to recognize this problem and provide solutions to the victim. Canada is allowing victims of violence to apply for a temporary resident permit that is fee-exempt. The permit will provide the victim and his or her children with legal immigration status in the country for a minimum period of six months. The new rules came into effect on 26th July 2019
The program, according to an immigration officer is intended among other things, is to allow the victims of family violence to escape the hold that the primary visa holder and abuser has on them.

What Is the Eligibility for TRP under Canada Immigration

The Canada immigration authorities will consider the following criteria to assess eligibility for the program
1. Is the foreign national living currently in Canada and experiencing any form of abuse from their spouse or common-law partner? Abuse in this case, can include psychological, verbal, physical, or financial abuse. It also includes extreme neglect of spouse and children as a form of abuse.
2. Is the foreign national seeking permanent residence, which is contingent upon their remaining in a relationship with the abusive partner. In other words is the application for permanent residency forcing them to continue to live under abuse.
Individuals who are eligible for the TRP for family violence program are most likely to be also be eligible for health-care benefits. Foreigners who have a temporary residence permit will also be eligible to apply for an open work permit, and will not be required to pay any fees.
