The case in question involved a 26-year-old woman who was riding as a passenger in another person?s vehicle. The vehicle the woman was in struck another that was parked in the middle of a highway.
?My client sustained serious injuries to her abdomen requiring surgery that resulted in removal of 60 percent of her lower intestine,? explained Edward Smith, a Boulder personal injury attorney and principal at The Law Offices of Edward Smith.
Seriously injured through no fault of her own, the victim sought legal counsel. As Smith?s office began investigating the crash, it learned the vehicle that had been parked in a travel lane was owned by a car dealership. The dealership was also named in the subsequent lawsuit in addition to the driver that left it parked where it did not belong. The driver happened to be a manager at the dealership and was driving a company vehicle at the time of the collision, Smith said.
?It turned out the manager had been drinking prior to the accident, as well,? Smith said. ?I sued the car dealership under the doctrine of Respondeat Superior, alleging that because the manager was driving a company vehicle he should be considered in the course and scope of employment and, therefore; the dealership should be held responsible.?
The case was on track to head to a two-week trial, but was settled during mediation one week before the start date arrived.
