National Herald Case - Has the court given time for Congress to destroy evidence?

India ? 24-12-15 ? Outside the Patiala House court on 19th December, there was a festive environment. Sonia and Rahul Gandhi were summoned by the court for hearing on the National Herald case. The complainant was Subramanian Swamy who was the prime person in bringing the 2G scam to the forefront. Hailing from the state of Tamil Nadu, he is an economist and a former cabinet minister. He was the President of the Janata Party who merged his party with BJP in 2013. Swamy had served as a member of the Planning Commission of India and Cabinet Minister of India. He has written on foreign affairs of India dealing largely with China, Pakistan and Israel. He is also a published author.

People who have made their decision clear in the 2014 elections, to root out the corrupt government of the UPA being fed by its scams and misgovernance, were happy to hear that finally the prime duo, the mother and son of the grand old party of India are prime accused in the National Herald case. Amounting to a tune of Rs.5000 Cr, this scam surrounding the oldest newspaper of independent India was the only one which saw the direct involvement of the Sonia and Rahul. The National Herald newspaper had been rewarded with so many real estate assets at prime locations of many metro cities spanning across India. Buildings present at these locations are rented to various government offices, one such office being the Mumbai passport office. The rents alone from few such buildings are somewhere near 60 Lakhs rupees per month. All such properties were acquired by Sonia and Rahul by illegal methods.

So when the court summoned the duo, everyone was intent in knowing the outcome of hearing. The situation has been overhyped by statements made by Rahul Gandhi that they would not apply bail and both of them were ready to go to jail. But on 19th December morning, Sonia and Rahul reached the court and appeared before the court and allegedly applied for bail while paying the bond amount and requesting for extension of the next hearing date from the date specified by the Judge to Feb 13th and then to Feb 20th 2016.

Subramaniam Swamy, who requested the Judge to confiscate the passports of the accused in order to prevent them from escaping the country was very confident that by paying the bond amount they proved that they are guilty and whatever lies they are feeding to the media isn?t if much potent when they themselves changed their stance to not take bail and then at the last minute changed their strategy.

But isn?t the Indian Judiciary enough lax for criminals that they are letting go of influential politicians who have all the power in their hands to tamper with the evidence available? On top of it the entire Judge has given them enough time, as much as that has been requested by the accused. Though this reasoning that the mother son duo are an influential part of the society, the Court should have taken into consideration what kind of influence they have been over the political scene in their recent stints of governance.

People will slowly and surely lose their confidence over courts. When ordinary citizens would be accused of something far less circumstantial, they have to spend their entire lifetimes going around the courts trying to prove their innocence. But when 5000 crores stake is riding over this case, the Judge hasn?t quite taken enough time to grant them bail. Hope these changes soon.
