In the spring of 2011, Catherine Hudson, who was then 53 was suffering severely diminished quality of life as a result of Multiple Sclerosis. After careful consideration of their options, she and her husband Robert made the difficult decision to admit her into the Symphony of Crestwood Nursing Home for long-term care.
In the spring of 2013, Catherine developed pressure sores which became infected. In June of 2014, she suffered a knee fracture. Both of these incidents caused considerable concern for Catherine's family which they voiced to staff and management in both instances.
However, the care Catherine received did not improve. In August of 2014, staff improperly reinserted a gastrostomy tube. This allowed food to seep into her body which caused a severe infection that ultimately claimed her life 11 days later.
Robert Hudson claims the injuries and infections Catherine suffered were entirely preventable and given Catherine's weakened health, staff should have taken greater care in ensuring their prevention. Further, Robert claims staff were negligent in following established medical procedures which further exacerbated her injuries.
"As a wrongful death attorney in Chicago, I have seen many cases similar to Mrs. Hudson's. It is a growing problem where the negligent behaviors of nursing home staff are causing serious injury and even death," remarked John Power.
Mr. Hudson's suit claims that Catherine was entirely dependent on the treatment provided by nursing home staff. The suit claims that given the severity of her MS, she was unable to adequately voice her concerns and request treatment, or even to recognize the growing seriousness of the infection that claimed her life.
The Illinois Department of Public Health agreed and cited Symphony of Crestwood for failing to properly place the feeding tube. Further, the IDPH determined that staff failed to cease the administration of feedings once it became clear that the device had malfunctioned and an infection was present.
"There was a clear pattern of negligent behavior by the nursing staff and management within the Symphony of Crestwood Nursing Home. Catherine Hudson experienced three serious and entirely preventable incidents in the span of less than three years. That is not only inexcusable, it is something they must be held accountable for," chastised John Power.
