CEOs Fall Raises Questions about Gym Safety

Getting in shape and staying fit requires exercise, and Survey Monkey CEO Dave Goldberg was determined to improve his health and trim the bulge from his waistline. Unfortunately, Goldberg's determination to exercise on May 1st while vacationing in Mexico proved deadly.

Goldberg was staying at a private villa near Punta Mita when he slipped and fell while utilizing the treadmill within the hotel's gym. The fall resulted in severe brain trauma and considerable blood loss that emergency room physicians were unable to stop, and he passed away shortly after his arrival at the hospital.

"Many people are writing Goldberg's accident off as a freakish accident. Either out of shock or disbelief, the reality is that it's a common accident and treadmills account for roughly 60% of all gym related injuries. While most are not fatal, these seemingly innocuous machines pose a considerable risk within gyms across the country. Every year, statistics show that three or four people are killed while using treadmills," remarked Domenic Maciarello, a Chicago personal injury attorney at Dworkin & Maciariello.

The exact circumstances which led to Goldberg's injury are being investigated right now, however, it does not appear mechanical failure was a factor. More likely, Goldberg was using a high powered machine and either lost concentration, or chose a setting that was beyond his physical abilities. Either possibility could cause a person to lose their footing and slip.

"Every day, millions of Americans head to the gym. Most enter with few concerns about their health and safety; especially when they intend to use equipment they believe to be innocuous and safe. The reality is that every piece of equipment within the gym has the potential to cause serious harm. That is why it is important for operators and patrons to follow safety procedures and ensure that operating protocols are adhered to at all times," posited Maciarello.

While Mexican officials are not conducting a criminal investigation, a private investigation is possible in the near future. If such investigation determined that the equipment was faulty, or that the equipment was placed improperly within the home gym making it unsafe to use, there is the possibility that either the homeowner or the manufacturer could be facing a wrongful death lawsuit.
