In the US state of Arkansas, a new law that has been passed will ensure that women will mandatorily have to ask permission from the man who impregnated her before she can have her pregnancy terminated.
Even in circumstances of rape, the women wishing for a pregnancy termination will have to notify and get consent from their abusive partner or attacker. Legal guardians and parents of girls under the age of 18 will also be able to decide whether their daughter gets to have her pregnancy terminated. The bills, which was then signed into law in the month of March, allow the woman?s sexual partner to block her access to pregnancy termination, if they don?t approve of the abortion, regardless of the circumstances.
The change in legislation, is set to come into effect at the July end, but reproductive and civil rights organizations and lawyers who are against this law are preparing for a court challenge against this new regulations, which they commented, - would place unwanted and severe restrictions/ burden of women?s rights.
Pro-Choice supporters speak up
A representative of a national pro-choice firm opined that the obvious intention and inevitable outcome of this plan is to make it harder for women to access the needed healthcare by placing more and more barriers between the women and her doctor.
The recently passed law, also states the family members must decide on how to dispose the body of their dead relatives, a term that will now be applicable to aborted fetuses as well.
A lawyer for Centre of reproductive rights commented that due to this onslaught of laws, people are witnessing a new, creative and very cruel attempt by the Arkansas to make accessing abortion more difficult, more impossible for women as well as to stigmatize and demean them in the meantime.
A legal challenge against the bill will be launched by pro-choice and abortion rights groups which will be heard in the court on Thursday.
Everyday women from Arkansas struggles to receive the abortive care they require, as legislators find new ways impose restrictions and shut down abortive clinics so as to make abortion unavailable, said the civil liberties union in a statement.
These women cannot afford to have further limitations to their access to pregnancy termination. They cannot manage to fund enough to travel miles to get abortion pills or required surgery to access abortion. They should not have to endure unwarranted invasion of privacy and violations of their autonomy.
According to research by a reproductive healthcare institute, Arkansas, the southwestern states of USA with population of nearly three million people, only have 4 abortion facilities. Before having a pregnancy termination, women in the American state must have counselling and then wait for 48 hours [ 2 days] before the procedure is provided.
