Class Action Filed Against Cox Comm. CA For Alleged Labor Code Violations

In February 2016, [Irvine Law Group, LLP] filed a class action lawsuit on behalf of a former employee of Cox Communications California LLC and other employees similarly situated, alleging causes of action for failure to pay overtime and double time compensation; failure to provide meal periods; failure to provide rest periods; failure to provide accurate itemized wage statements; as well as unfair competition and business practices (Amiri vs. Cox Communications California LLC: Orange County Superior Court Case No. 30-2016-00835723-CU-OE-CXC).
Rod Bidgoli, a Partner at the law firm of [Irvine Law Group, LLP](http://wagelawattorneys.com/) who is representing the Plaintiffs explained: "Plaintiff alleges that certain field employees were from time to time required to work shifts which exceeded eight hours per day, and/or forty (40) hours per week. Cox, however, failed to compensate Plaintiff and Class Members for all of the overtime and double time compensation to which they were entitled." In addition, Plaintiff alleges that he and Class Members were unable to avail themselves of their statutorily mandated meal or rest periods.
In March 2016, Defendant Cox Communications California LLC filed with the United States District Court for the Central District of California, Southern Division (Case No. 8:16-cv-00540-CJC-RAO), a Notice of Removal of the action from the Superior Court of California.
Rod Bidgoli stated Plaintiff intends to amend the action to add a cause of action under Cal. Labor Code § 2698, et seq., the Private Attorney General Act of 2004 (known as PAGA). PAGA allows a private citizen to pursue civil penalties on behalf of the State of California Labor and Workforce Development Agency (LWDA). Unlike other private attorney general lawsuits that usually involve some type of unfair competition claim, PAGA gives a private citizen (i.e. an employee or a former employee) the right to pursue fines that would normally only be available to the State of California. In essence, under PAGA an employee is deputized to act as a Private Attorney General.
The Cox case is currently pending in the U.S. District Court for the Central District of California in Santa Ana, California. No trial date has yet been set. The case has been assigned to Hon. Judge Cormac J. Carney.
